Terms of Service

1. Acceptance of Terms

By accessing or using Exploit Score's vulnerability prioritization platform and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Services

Exploit Score provides a cloud-based vulnerability prioritization platform that uses machine learning to analyze and score vulnerabilities based on exploitability risk. Our Services include:

  • Vulnerability data import and management
  • ML-powered exploit scoring and prioritization
  • Dashboard and reporting features
  • Integration with vulnerability scanners
  • API access (where applicable)

3. Account Registration

To access our Services, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access
  • Accept responsibility for all activities under your account

4. Subscription and Fees

Access to our Services requires a paid subscription. By subscribing, you agree to:

  • Pay all fees according to your selected plan
  • Automatic renewal unless cancelled before the renewal date
  • Price changes with 30 days advance notice
  • No refunds for partial subscription periods

5. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Reverse engineer, decompile, or disassemble the Services
  • Share account credentials with unauthorized parties
  • Exceed usage limits specified in your subscription
  • Use the Services to harm or exploit others
  • Interfere with other users' access to the Services

6. Data Ownership

Your Data: You retain all rights to the vulnerability data and other information you upload to the Services. You grant us a limited license to process this data solely to provide the Services.

Our Data: We retain ownership of our ML models, algorithms, scoring methodologies, aggregated analytics, and all intellectual property in the Services.

7. Service Level Agreement

For Professional and Enterprise plans, we commit to:

  • 99.9% uptime availability (excluding scheduled maintenance)
  • Scheduled maintenance with advance notice
  • Support response times as specified in your plan

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. EXPLOIT SCORES AND PRIORITIZATION RECOMMENDATIONS ARE PROVIDED FOR INFORMATIONAL PURPOSES AND SHOULD NOT BE THE SOLE BASIS FOR SECURITY DECISIONS. WE DO NOT GUARANTEE THAT USING OUR SERVICES WILL PREVENT SECURITY INCIDENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXPLOIT SCORE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Exploit Score and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Services or violation of these Terms.

11. Termination

Either party may terminate the subscription:

  • With 30 days written notice before renewal
  • Immediately for material breach not cured within 30 days
  • Immediately if the other party becomes insolvent

Upon termination, your access to the Services will end and you may request export of your data within 30 days.

12. Modifications

We may modify these Terms at any time. We will provide notice of material changes at least 30 days before they take effect. Continued use of the Services after changes take effect constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Delaware.
